Is this guy taking into account that, if a menu states that the prices do not include tax, the prices & tax collected are in fact correct? I don't think so.
Actual quote from Oklahoma statute Section 576: "The advertised price of a mixed beverage shall be the sum of the total retail sale price and the gross receipts tax levied thereon."
They can not legally advertise the price without including the tax!
And no one fudges on the strict terminology of the law? I think there needs to be a clear intent to defraud the customer & the OTC. I also have a question about "gross receipts tax", is this sales tax, mixed beverage tax or something else? 576 states the GRT is 12%, but sales tax is different for each city & county and mixed beverage is 13.5%.
The last post is 9/25/2011. I went to a local restaurant last night in Broken Arrow and ordered some wine. On the bill along with the state tax charge was a charge for 13.5% (called a liquor tax). What has happened with this lawsuit since 2011? Not being aware of the 13.5% tax on liquor and this being a new year I was not sure if this was something new because I had never seen it presented this way before.
